Terms of Service

These terms of service ("Terms") define the rules for the provision of services by Appsi P.S.A. with its registered office in Krakow ("Service Provider"), which holds the rights to the applications included in the Speci Service.

In order to use the service, the Client must accept these Terms. When the Client confirms acceptance of the Terms, an agreement is concluded between the Client and the Service Provider under the rules and conditions set out below.
I. Definitions
1. Speci Terms of Service (Terms) - these terms defining the rules for providing the Speci Service, its applications, and use of a Speci Account, available at https://speci.io/en/terms-of-use.
2. Speci Service - a set of applications, including the Speci mobile application for iOS or Android, a business card website, and the Administration Panel.
3. Service Provider - Appsi P.S.A., ul. Zamknięta 10 lok. 1.5, 30-544 Krakow, Poland, tax identification number NIP: 6762600061, REGON: 389416704, KRS: 0000910122.
4. Client - a natural or legal person using the Speci Service. One Client may create multiple Users.
5. Client Password - a string of characters consisting of digits, letters, or special characters, set by the Client during creation of a Speci Account and used to authorize access to that account.
6. Client Login - a unique email address used together with the Client Password to authorize access to the Speci Account.
7. Speci Account - a separate area of the Speci Service identified by a unique Client Login and secured with a Client Password.
8. User - a natural person who uses a Speci Account on behalf of and for the benefit of the Client.
9. User Account - an account created for a given User by the Client, available through an individual login and password, allowing the User to access the Speci Account.
10. Administration Panel (Portal) - a web portal forming part of the Speci Service, used to configure the Speci Account and available only to a User with administrator rights.
11. License - a non-exclusive license to use the Speci Service.
12. Privacy Policy - information defining the obligations, purposes, and rules related to personal data processing and protection in the Speci Service, available here.
13. Registration - the process of creating an account by completing the registration form and saving it.
14. Package - the scope of functionalities available within the Speci Service.
15. Virtual Business Card - a website that the Client may create and use to publish information about its business.
16. Platform - all computer applications forming part of the Speci Service and the server infrastructure on which they are maintained.
II. Introductory Provisions
1. These Terms define the conditions for using the Speci Service, including the mobile version of the Speci application, the Virtual Business Card, and the Administration Panel.
2. Use of the application constitutes consent to the Terms, full acceptance of all conditions set out in them, and an undertaking to comply with the obligations arising from them.
3. The Service Provider may temporarily restrict or disable access to the service for a User who uses it in breach of these Terms.
4. The service may be used to different extents depending on the selected plan or Package. Details regarding Packages and payments are described in the Packages and Payments section.
5. The Service Provider reserves the right to amend these Terms and will notify Users of each change by email. Any change to the Terms will take effect on the first day of the following month, provided that at least 14 calendar days pass between publication of the new Terms and their effective date.
6. A User may refuse to accept the amended Terms and discontinue use of the service.
7. If the User resigns from the service after a change to the Terms, the User may:

a) continue using the service until the end of the validity period of the previous Terms without changes and resign no later than the last day of that period;

b) resign at any time after publication of the new Terms and before the end of the validity period of the previous Terms.
8. The method of resignation due to a change to the Terms is described in section V, Agreement for Use of the Service.
9. Failure to resign within the specified time limit constitutes acceptance of the new version of the Terms.
III. Types and Scope of Speci Services
1. Speci is a service enabling professionals from different industries to organize their daily work, communicate with clients through a dedicated communication channel, and present their business online through a virtual business card and online photo gallery.
2. The following services are available within Speci:

a) the Speci mobile application;

b) the Virtual Business Card (website), configured through the Administration Panel;

c) the Administration Panel (web portal).
3. The Service Provider will ensure appropriate availability of the service, subject to the exclusions described in section X.
IV. Packages and Payments
1. The application may be used to different extents depending on the selected plan or Package.
2. The current price list and Package descriptions are available on the Speci website.
3. Packages may be purchased through the mobile application or the Administration Panel.
4. The Service Provider reserves the right to change the price list and available Packages.
5. Changes to the price list or scope of Packages will be published on the application website without the need to amend these Terms.
6. Users will be notified by email each time the scope of Packages or their prices change.
7. A price list change will take effect on the first day of the following month, provided that at least 14 calendar days pass between publication of the new price list and its effective date.
8. After a change to the Package scope or prices, the User may resign from the service.
9. If the User resigns from the service after a change to the price list or Package scope, the User may:

a) continue using the service until the end of the validity period of the previous Package scope or price list without changes and resign no later than the last day of that period;

b) resign at any time after publication of the new Package scope or price list and before the end of the validity period of the previous Package scope or price list.
10. The resignation procedure is described in section V, Agreement for Use of the Service.
11. Failure to resign within the specified time limit constitutes acceptance of the new Package scope or price list.
V. Agreement for Use of the Service
1. The agreement for use of the Speci Service is concluded through Registration and requires acceptance of the Terms. Lack of acceptance prevents Registration.
2. The agreement for use of the service is concluded for an indefinite period.
3. After Registration, the Client receives access to the free Package of the Speci Service. Package descriptions are available on the Speci website.
4. The User may purchase a paid Package of the Speci Service in accordance with section IV.
5. In order to enable the User to use the service, the Service Provider grants the User a non-transferable, non-exclusive license, valid for the period of use of the service. The License authorizes the User to use the service for its intended purpose and in accordance with these Terms. The License does not grant any other rights, in particular copyright or ownership rights.
6. Copyright and ownership rights belong to Appsi P.S.A. The source code and any content related to the application, including website materials, videos, and marketing materials, may not be used without the owner's written consent.
7. Any infringement of copyright or property rights may result in the User being held legally liable.
8. The Service Provider does not guarantee that the Speci Service is free of errors or that the User will be able to use it without problems or interruptions.
9. To create an account, the Service Provider requires a login, which is an email address, and a password.
10. One email account may be used to create one User Account.
11. All data provided by the User is provided voluntarily. The Service Provider does not require the User to provide any data other than an email address in order to use the service.
12. The User is fully responsible for their actions in connection with use of the service and for any content placed in it.
13. The User may resign from the services and terminate the agreement at any time without giving a reason:

a) for free accounts: by deleting the User Account using the Speci mobile application or Administration Panel. Account deletion results in deletion of all User data without the possibility of recovery. Actual deletion of data may take up to 14 business days from account deletion, but this does not affect the User's inability to recover the data;

b) for paid accounts: by sending a resignation statement to speci@speci.io in order to cancel the subscription and delete the User Account. The Service Provider does not refund fees paid in advance for an unused period if the User terminates the agreement. Actual deletion of data may take up to 14 business days from account deletion, but this does not affect the User's inability to recover the data.
14. The Client may resign from the services and terminate the agreement due to a change to the Terms or a change to the Package scope or price list between the announcement of the new Terms, Package scope, or price list and its effective date:

a) for free accounts: by deleting the User Account using the Speci mobile application or Administration Panel. Account deletion results in deletion of all User data without the possibility of recovery. Actual deletion of data may take up to 14 business days from account deletion, but this does not affect the User's inability to recover the data;

b) for paid accounts: by sending a resignation statement to speci@speci.io and deleting the User Account. If the User resigns due to a change in Package scope or price list before the end of the billing period, the Service Provider will refund the service fee proportionally to the unused period. The Service Provider will inform the User of the amount due and refund it within 14 business days to the provided bank account. Account deletion results in deletion of all User data without the possibility of recovery. Actual deletion of data may take up to 14 business days from account deletion, but this does not affect the User's inability to recover the data.
VI. Rights and Liability of the Speci Service Provider
1. The Speci Service Provider undertakes to:

a) provide services consistent with the nature of its business, with due care and attention to Users;

b) use technological solutions ensuring stability of the application and durability of data entrusted by Users. In the event of a failure, the Service Provider may restore the service to the state of the latest backup available to it;

c) inform Users in advance of all material changes concerning operation of the service, such as changes to the Terms, Package scope, price lists, and maintenance breaks.
2. The Speci Service Provider is not liable for:

a) data entered by Users into the mobile application, online business card, or online photo gallery;

b) damage resulting from improper use of the application;

c) damage resulting from failure to comply with personal data protection law;

d) damage resulting from lack of access to the service where access was blocked because the User used the service in breach of the Terms;

e) damage resulting from lack of access to the service caused by factors beyond the Service Provider's control;

f) damage resulting from data loss and the costs of restoring data where the loss occurred due to the User's use of the service contrary to its intended purpose, these Terms, or applicable law.
3. The Speci Service Provider may:

a) provide data concerning its Users and content entered by them at the request of judicial authorities in accordance with applicable law;

b) provide data concerning its Users and content entered by them in the event of an inspection by the Personal Data Protection Office in accordance with applicable law;

c) temporarily disable access to the service in order to carry out necessary maintenance work. Such breaks will be communicated in advance and, where possible, performed at night;

d) refuse to provide services to a User where there is suspicion that the User may destabilize the operation of the entire service, for example due to excessive load on the service.
VII. Obligations and Rights of the Client and User
1. The User undertakes that:

a) they will use the Speci Service only as intended;

b) they will enter and process their clients' data in accordance with applicable personal data protection laws and fulfil the information obligation towards those clients. The Service Provider does not require entry of third-party data in order to use the service;

c) they hold copyright to photos published in the online photo gallery;

d) they own the data entered into the online business card or have the right to publish it;

e) they will not place in the mobile application, online photo gallery, or online business card any content generally considered offensive, inciting hatred, pornographic, or otherwise violating applicable law or these Terms. If such content is placed, the Service Provider may remove it without prior notice and temporarily block the User Account until the matter is clarified;

f) they will keep the Login and Password confidential and will not disclose them to third parties in order to allow other persons, including the Client's employees, to log into the system. One license authorizes one natural person to log into the system.
2. The Client has the right to:

a) use the Speci service within the selected Package and assigned License;

b) select, change, or resign from a Speci Package in accordance with section IV;

c) receive advance information about changes to the Terms, Package scope, and price lists as described in sections II and IV;

d) report comments concerning irregularities in the service, as well as suggestions for adding new functionalities, by email to speci@speci.io or through the contact form.
VIII. Complaints Concerning Incorrect Operation of the Service
1. The User may submit complaints concerning operation of the Speci Service electronically to speci@speci.io.
2. A complaint should be submitted within 14 calendar days from the date of the event that is the subject of the complaint.
3. A complaint should include a detailed description of the problem. The Service Provider reserves the right to request additional explanations or information from the complainant if required to examine the complaint.
4. The Service Provider will review the complaint within 30 calendar days from the date of submission.
5. Matters not regulated in these Terms are governed by the provisions of the Civil Code.
IX. Technical Requirements
1. Internet access is required to use the Speci Service. The application is available for mobile devices and may be downloaded only from authorized stores, Google Play and the App Store, and may also be used on desktop devices (computers).
2. The mobile application is available for Android version 11.0 or later.
3. The Administration Portal and Virtual Business Card are available in the latest manufacturer-provided versions of Chrome, Firefox, Safari, and Opera browsers.
4. An account created in the Portal enables login with the same credentials in the Application, and an account created in the Application enables login through the Portal. The User may not create more than one Account using the same email address.
X. Data Security and Personal Data Protection
1. The Speci Service Provider is responsible for correct processing of data entered by Users into the service, in accordance with accepted rules of computer system operation and generally applicable law, including in particular data security, copying, and deletion.
2. The Speci Service Provider declares that it has appropriate technical and organizational measures, knowledge, and qualified personnel enabling it to properly perform these data processing entrustment terms and ensure processing compliance with law and protection of the rights of data subjects.
3. The Service Provider ensures that persons with access to personal data are obliged to maintain confidentiality when processing personal data.
4. The Service Provider undertakes to ensure that solutions adopted in the Speci Service meet security standards required by applicable personal data protection laws and implementing regulations, in particular regarding documentation of personal data processing and technical and organizational requirements for devices and IT systems used to process personal data.
5. The Speci Service Provider will notify the User without undue delay of personal data protection breaches.
XI. Processing, Protection, and Entrustment of Personal Data
1. By creating a User Account, the User accepts the Terms and thereby consents to personal data processing in accordance with personal data protection law.
2. The User is the sole owner of all data entered by the User into the Speci Service. The User decides the scope of data stored in the Speci Service.
3. Data entered by the User is visible only within the company for which the User was created.
4. The User is the controller of personal data entered into the Speci mobile application, the Virtual Business Card, and the Administration Panel. The User entrusts, and the Speci Service Provider accepts, processing of that personal data for the purpose and within the scope specified in the Agreement.
5. The entrustment referred to in point 4 takes place in order to enable the Speci Service Provider to properly perform its obligations under the Agreement, to the extent necessary for their performance, and includes in particular access to personal data, processing of personal data, and storage of personal data in connection with performance of the Agreement.
6. The User agrees that the Service Provider may further entrust personal data processing ("Sub-entrustment") and performance of tasks under the Agreement to a third party, provided that:

a) the scope and purpose of Sub-entrustment will not be broader than those arising from the Terms;

b) Sub-entrustment will be necessary for performance of the Agreement;

c) Sub-entrustment will not violate the interests of the entrusting party.
7. Sub-entrustment may occur in order to ensure technical operation of the application and durability of data; data may be copied, reproduced, and stored on servers located in data centers operated by third parties providing data storage and security services to the Service Provider.
8. The Speci Service Provider is the controller of data of Speci Service Users. The Speci Service Provider collects and processes personal data of Speci Users in order to perform the agreement.
9. All data is stored on servers located within the European Union.
10. All data transmitted over the Internet is encrypted to prevent interception.
11. When using the Application, in addition to data entered by Users, data such as the User's IP address, browser type, and operating system type may also be collected automatically.
By accepting these Terms, you agree to be bound by them.
These Terms of Service are currently available in English. In case of any differences between translations, the English version shall prevail. English version.
